INTRODUCTION

This Privacy Policy describes Rave Cinemas, LLC.’s, its subsidiaries and affiliates, (collectively “RMP”, “us”, “we” “our”) information gathering and privacy practices and applies to information we collect from you through our Web sites and services. Our Privacy Policy allows you to protect your personal information, while allowing us to provide you useful information, products and services. You are not obligated to provide us any personal information, and if, at any time, you no longer wish to receive communications from us, you are free to “opt out” of receiving these communications.

COLLECTION OF YOUR PERSONAL INFORMATION

In order to access certain information, services or products, our Web site’s registration form may require you to provide personal information, such as your name and e-mail address. We may also collect demographic information like your ZIP code, age and gender as well as other information, like your favorite movie style or preferred seating location. Finally, if you choose to make a purchase through our Web site, we will ask for additional financial information such as your credit card number, billing address and other relevant information. We may also collect the Internet Protocol address of visitors to our Web site, the e-mail addresses of those who post messages to our Web site, and the e-mail addresses of those who send us e-mail.

We may collect information about your interaction with our Web sites and services. For example, we may use Web site analytics tools to retrieve information from your browser, including the site you came from, the keywords you used to find our site and the pages you view. We may also use technologies, such as cookies and web beacons to collect information about the pages you view, the links you click and other actions you take on our site. Additionally, we collect certain Web site usage information which is anonymous information about our visitors that describes how our Web site is used and navigated. This information includes the number and frequency of visitors to each web page, their actions taken and the length of their stays. Web site usage information does not contain personally identifiable information. We may also retain third parties to place and manage advertisements on our Web site. These third party advertisers use cookies and other technologies to collect information about your visits to our Web sites in order to provide advertisements about goods and services that may be of interest to you. This information is not personally associated with you, and RMP may share it with third parties from time to time.

USE OF YOUR PERSONAL INFORMATION

We collect and use the information we collect through our Web site to enhance your experience in visiting our site. We may use the information we collect in a number of ways, including: (i) to communicate with you, including information about RMP, upcoming showings, special offers or promotions, or for other purposes disclosed when you submitted your information; (ii) displaying content and advertising customized to your preferences; (iii) to assist us in marketing and advertising our products and services and those of other businesses; (iv) to send you product surveys or promotional mailings; (v) to detect and prevent fraud, infringement, or other potential misuse of our Web site; and (vi) to fulfill your request for products or services, in which such event, we may share your information, including personally identifiable information with third parties who provide services to RMP, such as credit card processing, order fulfillment, and/or prize delivery.

RMP also combines anonymous usage information collected from your visit to an RMP Web site with that of other users to determine which features and areas of the Web site are most popular. RMP may also supplement personally identifiable information collected from you with information that we obtain from our subsidiaries and affiliates or other companies. If we associate information obtained from our affiliates, subsidiaries or third parties with personally identifiable information collected under this Privacy Policy, we will treat the acquired information like information we have collected ourselves. Personal information collected on our Web sites will be stored and processed in the United States or any other country in which RMP or its service providers maintain facilities. If you do not wish for us to transfer your personally identifiable information into the United States, do not submit it. If you provide us with personally identifiable information, we will treat your submission of that information as your consent to allow us to transfer it to the United States.

SHARING OF YOUR PERSONAL INFORMATION

If you expressly opt-in to receiving marketing communications concerning products or services offered by third parties, RMP will share the necessary portion of your personally identifiable information with those third parties for that limited purpose. This is typically, but not always, done by opting in to receive information from a third party that is participating in a sweepstakes or promotion on our Web site. If you do not want your information to be used by a third party for direct marketing or other purposes, do not opt in to such use by that third party. If you opt in to receive direct marketing from a third party, your information will be subject to that party’s privacy policy, and if you later decide you do not want that third party to use your information, you will need to contact that party directly. You should review the privacy policy of any party that collects information to determine how that entity will handle your information.

At any time you may opt-out of receiving marketing communications from us or request that we not provide your personally identifiable information to third parties.

We occasionally hire other companies to provide services on our behalf, such as processing and delivery of mailings, providing customer support, processing transactions, or fulfilling orders. Those service providers will be permitted to obtain only the personal information they need to deliver the service. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose. However, for credit card processing, our fraud detection vendors may use aggregate data to help improve their service. This helps them more accurately detect fraudulent uses of credit cards.

RMP may disclose personally identifiable information to third parties in relation to a potential corporate sale, merger, reorganization, or similar event. In such instances, RMP will treat your information as an asset and transfer it subject to certain confidentiality obligations of the transferee.

If you are a member of a social network service, such as Twitter, Facebook or a similar Web site where you have authorized them to gather information about your online and other behavior on RMP’s Web site (for instance, to notify your friends that you are going to a movie), including participation in any behavioral reporting program that such sites may operate, RMP may share information regarding your activities on RMP’s Web site with those third parties as authorized by you, and they may associate that information with personally identifiable information such site already has about you, and use it to improve their site or services or for other purposes. You must be comfortable with the privacy policies of any social network site that you authorize to gather information from RMP, as the privacy policies of these social network sites will govern the use of your personally identifiable information once it has been transmitted from RMP.

From time to time, RMP may be required to disclose personally identifiable information about you, including the content of your communications, in response to a court order, subpoena, government investigation, or as otherwise required by law. We reserve the right to report any activities that we believe to be unlawful. We also may share personally identifiable information when we believe that such sharing is reasonably necessary to: (a) protect the rights or property of RMP or our customers, including the enforcement of our policies governing your use of our Web site or theaters; or (b) protect the personal safety of RMP employees, customers or the public

CHILDREN’S USE OF OUR WEB SITE

RMP’s Web site is intended for general audiences and we do not knowingly collect any personally identifiable information from children. If our Web site does collect age information, and users identify themselves as under 13, the site will either block such users from providing personal information, or will seek to obtain consent from parents for the collection and use of their children’s personal information. We will not knowingly ask children under the age of 13 to provide more information than is reasonably necessary to provide our services. Please note that our site may contain links to content providers that collect information from children under the age of 13. We have no control over such content providers and are not responsible for the privacy practices or the content of other Web sites. Because the Internet offers open access to a wide range of information, it is important that parents supervise and prevent access to inappropriate content, email or chat sessions. We encourage you to talk with your children about communicating with strangers and disclosing personal information online.
